SEC Misused Witness At TPG Associate's Trial, 9th Circ. Told

Law360, San Francisco (February 12, 2013, 6:27 PM EST) -- A former TPG Capital LP associate urged the Ninth Circuit on Tuesday to rule that a lower court violated his due process rights in his insider trading case by allowing the U.S. Securities and Exchange Commission to rely on a key witness who was more mentally impaired than the agency claimed.

Vinayak Gowrish told a three-judge panel that investor Pascal Vaghar was the only SEC witness to testify against Gowrish, and that both the government and Vaghar had wrongly claimed he was 50 percent cognitively impaired....
