Apple Makes Case For Samsung Injunction To Fed. Circ.

By Ryan Davis (February 14, 2013, 8:12 PM EST) -- Apple Inc. told the Federal Circuit on Tuesday that it must overturn a lower court's decision not to impose an injunction on several Samsung Electronics Co. Ltd. smartphones that a jury found infringed Apple's patents, arguing that the judge used an incorrect legal standard.

Apple had initially asked the full Federal Circuit, rather than a panel, to hear its appeal of U.S. District Judge Lucy Koh's ruling that an injunction could not be issued because Apple failed to show that demand for Samsung's products was driven by the allegedly infringing features.
