CVS Denies Underfunding $34M OT Settlement

Law360, New York (February 19, 2013, 2:37 PM EST) -- CVS Caremark Corp. fought back Friday against claims that it had underfunded a $34 million overtime settlement with thousands of assistant store managers, saying an error by the settlement administrator was to blame.

Late last month, the plaintiffs in 11 consolidated wage-and-hour class actions accused the pharmacy giant of deliberately withholding an additional $1.9 million that was owed under a November 2011 settlement, and asked the court to enforce the settlement.
