Texas Lawmaker Wants To Clear Stalled Asbestos Cases

Law360, Dallas (February 19, 2013, 8:08 PM EST) -- A Texas lawmaker on Thursday filed legislation that would allow judges to clear thousands of long-pending asbestos and silica liability cases from a consolidated pretrial docket in Texas state court.

In H.B. 1325, Rep. Doug Miller, R-New Braunfels, proposes a clean sweep of cases filed before a set of 2005 tort reforms aimed at asbestos and silica litigation, in which the plaintiffs haven’t yet complied with a requirement to submit a medical report showing they were harmed by asbestos exposure.
