Travelers Dodges Coverage For Anesthetist's Sex Assaults

Law360, New York (February 22, 2013, 3:23 PM EST) -- A Georgia federal judge on Friday ruled that Travelers Indemnity Co. of America is not obligated to indemnify a hospital operator’s settlements with patients who were sexually assaulted by an anesthetist, saying the assaults constitute intentional acts excluded under its policy.

Duffey Jr. found that Travelers’ policy with Tri-County Anesthesia LLC and its affiliates provides for indemnification of bodily injury claims only if those injuries are the result of an accidental occurrence, thereby excluding coverage for the intentional acts of nurse anesthetist...
