How Not To Plead A Multistate Class Action

Law360, New York (March 1, 2013, 11:59 AM EST) -- A weak claim in the hands of a strong judge can result in an unpleasant experience, a defeat for the client and a written opinion which concludes, about the lawyers:

“We needn’t discuss the plaintiffs’ remaining claims ... as they are frivolous squared. This lawsuit, including the appeal, is a travesty. We are surprised that [defendant] UBS hasn’t asked for the imposition of sanctions on the plaintiffs and class counsel.”

We must suppose that Judge Richard Posner’s opinion of Feb. 7, 2013, for the United States...
