Judge Says FLSA Deals Don't Need Court Approval

Law360, New York (February 25, 2013, 8:48 PM EST) -- A New York federal judge ruled Friday that a lawsuit filed under the Fair Labor Standards Act could be settled without court approval, bucking the long-standing judicial aversion to private settlements under the workplace statute.

U.S. District Judge Brian Cogan reversed his own previous determination that Donna Picerni had to seek his approval for a settlement with Bilingual SEIT & Preschool Inc. resolving claims that the private tutoring company paid her less than minimum wage.
