Pa. High Court May Demand More From Asbestos Experts

Law360, Philadelphia (March 1, 2013, 6:25 PM EST) -- The Pennsylvania Supreme Court will consider Wednesday whether expert affidavits can establish asbestos exposure, giving it a third opportunity in recent years to stress to lower courts that plaintiffs need specific evidence supporting their allegations to survive summary judgment, defense attorneys say.

The high court will hear arguments in five companies' appeal of a 2011 Superior Court decision that vacated a trial court's dismissal of asbestos mass-tort claims. The defendants in the case, Howard et al. v. A.W. Chesterton Co. et al., include Ace Hardware Corp....
