Law360, New York (February 28, 2013, 11:34 AM EST) -- Although the California Department of Toxic Substances Control has not finalized the regulations pursuant to the Safer Consumer Products Act, they have now issued what appears to be their last draft for public comment, which ends Feb. 28. Already, manufacturers are budgeting millions of dollars for compliance expenditures beginning in the third and fourth quarters of 2013 for the time and cost-intensive alternatives analysis requirement.
Because the term "manufacturer" is defined to include "any person who … has the capacity to specify the use of chemicals" in a product, there may be manufacturers who escape liability on this technicality. But, manufacturers...
