TCEQ Asks Texas High Court Not To Expand Permit Hearings

Law360, Dallas (February 28, 2013, 9:24 PM EST) -- The Texas Commission on Environmental Quality on Thursday asked the Texas Supreme Court to overturn a ruling it says adds too heavy a burden to its wastewater permitting process and gives courts too much power to interfere with its administrative expertise.

The agency argued two Austin appeals court rulings, which held it should hold separate evidentiary hearings to determine which parties qualify as “affected persons” who have the right to intervene in permit applications, don't recognize the work agency staff already do in reviewing the applications....
