2nd Circ. Affirms Buffalo PD Win In White Cop's Bias Suit

Law360, New York (February 28, 2013, 6:07 PM EST) -- The Second Circuit upheld a victory for the Buffalo, N.Y., police department Wednesday in a race bias suit brought by a white captain who was passed over for promotion, rejecting his claim that the U.S. Supreme Court's 2009 Ricci decision established that the department violated Title VII.

A three-judge panel denied a challenge to the lower court's decision to grant summary judgment to the Buffalo Police Department and former chief H. McCarthy Gipson from plaintiff and police captain Mark Maraschiello.
