DOL Issues Final Rules To Stop Fraudulent Health Pools

Law360, New York (February 28, 2013, 8:03 PM EST) -- The U.S. Department of Labor on Thursday released final Affordable Care Act regulations that will give the department more freedom to shut down allegedly fraudulent multiple employer welfare arrangements, which operate like group health plans for small businesses and often operate outside state insurance regulation.

The rules allow the DOL's Employee Benefits Security Administration to more easily issue cease-and-desist orders and freeze the assets of MEWAs that the agency suspects are fraudulent or likely to cause significant public harm. The rules will go into effect 30...
