Fla. Appeals Court Strikes Down Workers' Comp Time Limit

Law360, Miami (March 1, 2013, 8:29 PM EST) -- A Florida appeals court on Thursday deemed a provision in the Florida Workers' Compensation Law that limits temporary disability benefits to 104 weeks unconstitutional and extended it to 260 weeks as stipulated by the previous statute.

Florida's First District Court of Appeal found the current law's “statutory gap” too often leaves injured workers in a limbo — no longer able to receive temporary benefits but also not yet eligible for permanent benefits — that violates their rights to access to courts and the administration of justice...
