Alphapharm Concedes To Forest Labs In Antidepressant Battle

Law360, New York (October 6, 2005, 12:00 AM EDT) -- Generic drug maker Alphapharm Pty Ltd. must steer clear of blockbuster antidepressant Lexapro for now as part its settlement agreement with Forest Laboratories Inc., ending litigation launched in May 2004.

Alphapharm, part of the generics division of Germany-based Merck KGaA, was sued by New York-based Forest and its Danish licensing partner H. Lundbeck A/S in U.S. District Court for the Southern District of New York. The case was transferred four months later to Delaware.
