Ex-Dukes Members Fight To Revive Wal-Mart Class Claims

Law360, New York (March 4, 2013, 8:38 PM EST) -- A trio of women who were part of the nationwide gender discrimination class nixed by the U.S. Supreme Court in its landmark 2011 Dukes ruling asked a Tennessee federal judge Thursday for the green light to appeal a recent decision that dismissed their regional class claims against Wal-Mart Stores Inc. as time-barred.

Cheryl Phipps, Bobbi Millner and Shawn Gibbons, who work or worked for Wal-Mart, asked U.S. District Judge Aleta A. Trauger to certify her Feb. 20 order for interlocutory appeal and stay their individual claims....
