Pa. Appeals Court Tosses Paxil Birth Defect Suit

Law360, Philadelphia (March 7, 2013, 5:30 PM EST) -- The Pennsylvania Superior Court on Monday affirmed the dismissal of a product liability suit in which an Ohio woman alleged that the antidepressant medicine Paxil resulted in her child being born with a fatal congenital heart defect.

While the judges rejected the trial court's decision to grant summary judgment in favor of GlaxoSmithKline LLC on the grounds that Mary Pettit had failed to adequately prove she had taken Paxil during pregnancy, the appeals court ultimately affirmed the dismissal of the suit by finding that she did...
