5th Circ. Upholds Block On Blood Clot Supplement 'Knockoff'

Law360, New York (March 6, 2013, 2:11 PM EST) -- The Fifth Circuit on Tuesday upheld an injunction blocking sales of a purported knockoff version of arterial blood clot reduction supplement Provasca allegedly developed from misappropriated trade secrets, ruling the injunction was reasonable based on available evidence.

In a published decision, the three-judge panel ruled that U.S. District Judge Kenneth M. Hoyt had enough evidence to properly determine Daniels Health Sciences LLC was likely to succeed on its claims against Vascular Health Sciences LLC, and that DHS faced a substantial threat of irreparable injury from VHS’...
