Ill. Appeals Court Holds Asbestos Insurers To 'All Sums'

Law360, New York (March 7, 2013, 2:50 PM EST) -- An Illinois appeals court ruled Tuesday that excess insurers should cover John Crane Inc.'s costs from more than 250,000 asbestos claims under the "all sums" approach, rejecting insurers' arguments that a landmark Illinois Supreme Court ruling on allocating long-tail claims didn't reach excess carriers.

John Crane, a manufacturer of asbestos-containing gaskets, successfully challenged the lower court's finding that umbrella and excess insurers should pay based on the pro rata allocation method, rather than the all sums approach.
