11th Circ. Backs Illegal Workers' Right To Pursue FLSA Claims

Law360, New York (March 6, 2013, 6:16 PM EST) -- The Eleventh Circuit ruled Wednesday that the U.S. Supreme Court’s ruling that undocumented workers cannot seek back pay for being axed over union activity doesn't prevent those workers from seeking unpaid overtime wages under the Fair Labor Standards Act.

The ruling came in a dispute involving former employees who had installed hurricane shutters for Safe Hurricane Shutters Inc., including Mario Feliciano and Augustin Milan, who had sued the company along with its directors, Steve Heidelberger and Francis McCarroll, to seek overtime wages, according to the opinion....
