Wells Fargo Associates Win Conditional Cert. In FLSA Suit

Law360, New York (March 12, 2013, 3:18 PM EDT) -- A Missouri federal judge on Monday granted early-stage certification to a class of Wells Fargo Advisors LLC employees who claim the brokerage failed to pay them overtime, allowing the plaintiffs to begin notifying potential class members.

U.S. District Judge John A. Ross said former Wells Fargo client associate Michelle R. Lindsay — who claims Wells Fargo forced her to under-report hours in violation of the Fair Labor Standards Act — had presented enough evidence to meet the fairly lenient requirements for conditional certification under the FLSA....
