Jury Hands Bard $185M Verdict In Graft Patent Case

Law360, New York (December 12, 2007, 12:00 AM EST) -- A jury ruled on Tuesday that drug maker W. L. Gore & Associates Inc. willfully infringed rival C.R. Bard Inc.'s patent on a type of prosthetic blood vessel graft, ordering the company to pay damages of $185 million, Bard announced on Wednesday.

The jury has not yet reached a verdict on whether the patent is unenforceable due to inequitable conduct, as Gore has contended, however.

A spokesperson for Gore could not immediately be reached for comment. Bard said that it expected a response from Gore....
