HHS Updates State Medicaid FCA Compliance Rules

Law360, New York (March 15, 2013, 4:49 PM EDT) -- A U.S. Department of Health and Human Services watchdog on Friday issued updated guidelines for how it evaluates whether state Medicaid false claims laws comply with federal standards, in the wake of several recent changes to the federal False Claims Act.

According to the HHS Office of Inspector General, the new guidelines will give states a clearer idea of whether their false claims statutes comply with a Social Security Act clause — Section 1909 — that gives them a larger percentage of any Medicaid-related FCA recovery...
