Mistrial Declared In Merck's 1st Fosamax Femur Trial

Law360, New York (March 18, 2013, 5:37 PM EDT) -- The judge in a New Jersey bellwether trial over whether Merck & Co. Inc.’s bone drug Fosamax caused a woman’s broken femurs declared a mistrial Monday, after the plaintiff suffered a heart attack.

Superior Court Judge Carol E. Higbee took the bench to declare a mistrial after attorneys informed her that plaintiff Christina Su had suffered a heart attack Sunday night, leaving her in no condition to continue with the trial.
