USPTO Eliminates AIA's Patent Review 'Dead Zone'

Law360, New York (March 22, 2013, 3:34 PM EDT) -- The U.S. Patent and Trademark Office on Friday released a rule eliminating so-called dead zones during which post-grant review would not be available for some patents under the America Invents Act. 

The patent office issued a final rule that implements a set of technical corrections to the AIA meant to counteract the problem of dead zones that observers had noted with respect to the patent law.
