Rehab Cos. Want Sanctions Against US In FCA Fight

Law360, New York (March 26, 2013, 4:31 PM EDT) -- Two physical therapy companies asked a Missouri federal judge Monday to sanction the federal government and toss a whistleblower’s false claims act suit alleging they exchanged kickbacks for referrals of Medicare business, saying the government’s evasive conduct in discovery warrants dismissal.

RehabCare Group Inc. and an affiliate say government attorneys have evaded court-ordered interrogatories asking them to identify individuals from co-defendant Rehab Systems of Missouri LLC who allegedly referred patients to RehabCare in exchange for kickbacks.
