Calif. Winemakers Jump Into Direct-Shipping Suit

Law360, New York (December 18, 2007, 12:00 AM EST) -- A California trade association representing winemakers is urging an appeals court to uphold a lower court’s ruling that two Indiana statutes that prohibit out-of-state wine producers from directly shipping to Indiana consumers are unconstitutional.

The amicus curiae brief, filed Dec. 14 by Family Winemakers of California in the U.S. Court of Appeals for the Seventh Circuit, argued that Indiana cannot seek to influence the laws of other sovereign states or punish wineries for benefits conferred by other states.
