Judge Opts For Plan C In Budget Rent-A-Car Spat

Law360, New York (December 19, 2007, 12:00 AM EST) -- Months after agreeing to certify a class of shift managers, the federal judge overseeing the group's employment case against Budget Rent-a-Car and parent company Cendant Corp. has declined to use the plaintiff's suggested class notice in the dispute over whether certain employees should be classified as exempt.

On Monday, U.S. Magistrate Judge Maria-Elena James partially denied Stanley Krzesniak's motion to adopt his class notice, ruling that neither his nor the defendants' proposal should be adopted in their entirety.
