Dallas Claims City Judges Lack Standing To Fight Ouster

Law360, Dallas (April 23, 2013, 4:35 PM EDT) -- The city of Dallas on Tuesday argued four ousted municipal court judges don’t have standing to challenge the appointment of their replacements because their suit can’t lead to them being reinstated, and asked a state appeals court to throw out the claims.

The city argued because the judges’ two-year terms had expired nearly three months before replacement appointments were made, they have no standing because they were, at the time, equivalent to average public citizens who were not personally harmed by the City Council’s choices for...
