5th Circ. Sinks Patent Suit Over BP's Deepwater Plunger

Law360, Los Angeles (April 3, 2013, 10:35 PM EDT) -- The Fifth Circuit on Wednesday tossed a complaint filed by a woman who says BP Exploration & Production Inc. misappropriated her patented plunger idea when it stopped the Gulf of Mexico oil spill in 2010, ruling she hadn't made any plausible claims.

The three-judge panel agreed with a district court's ruling that Velma Jean Richards had failed to state a claim that the oil company made, used or sold any copyrighted or patented inventions owned by her.
