Promega DNA Products Infringe Caltech Patent, Judge Finds

Law360, Los Angeles (April 5, 2013, 4:58 PM EDT) -- Circuit Judge Richard A. Posner ruled Thursday that Promega Corp.'s DNA fingerprinting products infringe a California Institute of Technology patent and that Promega flouted a licensing contract with Life Technologies Corp. by failing to pay a 2 percent royalty on product sales.

Judge Posner found that Promega's DNA fingerprinting products infringe three claims on a patent disclosing fluorescence-based DNA analysis, saying the claims were valid as defined in a 2006 cross-license agreement between Promega and a Life Tech predecessor.
