Court Makes U-Turn In UPS Deaf Drivers Case

Law360 (January 3, 2008, 12:00 AM EST) -- Marking a major turnaround, an appellate court reversed an earlier panel ruling on Friday that United Parcel Service Inc. violated national labor laws by excluding the hearing-impaired from truck driver positions.

The 13-2 decision was handed down Friday in the U.S. Court of Appeals for the Ninth Circuit. It found that a district judge used the wrong standard in a 2004 decision that UPS – the world's largest private package carrier – discriminated against deaf people by categorically excluding individuals who did not meet the U.S....
