9th Circ. Revives State Claims In Gas Price-Fixing MDL

Law360, New York (April 10, 2013, 9:26 PM EDT) -- The Ninth Circuit on Wednesday revived state-law claims in multidistrict litigation against several natural gas companies alleging they fixed the price of natural gas, overturning a ruling that federal energy regulators had jurisdiction over the companies' conduct and the state claims were preempted.

The appeals court said the Federal Energy Regulatory Commission has less authority under the Natural Gas Act than the trial court had believed, with the law placing certain practices of the interstate gas industry outside FERC's jurisdiction.
