Supreme Court Passes On Conoco Worker Injury Lawsuit

Law360, New York (April 15, 2013, 7:23 PM EDT) -- The U.S. Supreme Court declined Monday to review a Third Circuit ruling that found a federal court did not have grounds to hear Norwegian workers' personal injury claims against ConocoPhillips Co., even under the Class Action Fairness Act.

The appeals court's decision vacated a Delaware federal judge's dismissal of the claims on the basis of forum non conveniens. With the Supreme Court's rejection of ConocoPhillips' petition for certiorari, the claims will now proceed in Delaware state court, where they were originally filed.
