Aetna Avoids Arbitration Of Suit Over $99K Ear Wax Removal

Law360, New York (April 15, 2013, 5:34 PM EDT) -- The Fifth Circuit on Friday refused to force Aetna Life Insurance Co. to arbitrate its claims that a Texas hospital improperly reaped millions of dollars by enticing patients to use its out-of-network services and charging wildly excessive fees, including $99,750 for ear wax removal.

The decision, which upheld a district court’s ruling, contained little explanation, saying only that Humble Surgical Hospital LLC “has shown no entitlement to relief from this court at this time.”
