Pumping Oil Into Tanks Counts As Discharge, 2nd Circ. Hears

Law360, New York (April 15, 2013, 7:51 PM EDT) -- Colonial Oil Industries Inc. continued its battle against Indian Harbor Insurance Co. over legal and remediation costs linked to a PCB-contaminated fuel oil, telling the Second Circuit on Monday that its insurance policy covers discharges into any structure, even if it did not leak into the environment.
