Texas, Electric Cos. Ask DC Circ. To Nix EPA Boiler Rule

Law360, New York (April 15, 2013, 6:25 PM EDT) -- Texas state regulators and an electric generator industry group urged the D.C. Circuit on Friday to shoot down the U.S. Environmental Protection Agency's 2012 new source performance standards for steam generating boiler units, claiming that agency never explained or sought comment on the requirements.

The Utility Air Regulatory Group joined the Texas Commission on Environmental Quality and other state agencies in a petition against the emissions requirements, filing a new brief with the court after the EPA agreed to reconsider a portion of the NSPS standards....
