Weyerhaeuser Loses Dispute Over Asbestos Claims

Law360, New York (January 7, 2008, 12:00 AM EST) -- Weyerhaeuser Co. was wrong to file asbestos liability claims under coverage policies set before the people who made the claims were actually exposed, a judge has ruled, handing partial summary judgment to the lumber company's insurer, Fireman's Fund Insurance Co.

Dismissing Weyerhaeuser's claim that it should be allowed to select the earliest policy year triggered for the two asbestos claims in dispute, Judge Marsha Pechman of the U.S. District Court for the Western District of Washington rejected the company's cross-motion on Jan. 2.
