Donziger Counterclaims In $19B Chevron Suit Rejected

Law360, New York (April 16, 2013, 2:27 PM EDT) -- A New York magistrate judge delivered another blow to Ecuadorean plaintiffs accused of racketeering by Chevron in connection with a $19 billion environmental judgment, recommending Monday that extortion and fraud counterclaims brought by attorney Steven Donziger should be dismissed.

U.S. Magistrate Judge James Francis IV determined that Donziger’s attempted civil extortion and duress claims against Chevron should be tossed because the dispute is appropriately situated in New York, a state that does not recognize a cause of action for such claims.
