Fla. Bill Limits Punitive Awards Against Nursing Homes

Law360, Miami (April 16, 2013, 6:36 PM EDT) -- A Florida Senate panel on Tuesday advanced a bill that would make the requirements for seeking punitive damages in negligence lawsuits against nursing homes more stringent by requiring evidentiary hearings prior to allowing punitive damages claims.

The Senate Health Policy Committee voted 6-3 to send along S.B. 1384, which toughens the standards for allowing punitive damage claims and prohibits the use of a state or federal survey of nursing facilities to establish entitlement to punitive damages.
