Mo. Appeals Court Reinstates $62M Lloyd's Pollution Verdict

Law360, New York (April 16, 2013, 7:29 PM EDT) -- A Missouri appeals court on Tuesday reinstated a $62 million pollution verdict against underwriters at Lloyd’s of London in its dispute with a lead smelting company, saying the lower court erroneously applied New York law in issuing a prorated $5 million final judgment.

The Missouri Eastern District Court of Appeals backed Doe Run Resources Corp.’s argument that Missouri law should apply in its dispute with Lloyd’s and ordered the lower court to reinstate the full $62 million jury verdict over coverage for contamination at mill sites...
