Settlements Start Clock On UIM Arbitration: Appeals Court

Law360, Philadelphia (April 22, 2013, 4:25 PM EDT) -- The Pennsylvania Superior Court ruled Friday in a precedential decision that the four-year statute of limitations on arbitration over underinsured motorist claims begins on the date of the settlement with the underinsured driver.

The appeals court affirmed a trial court order denying an effort by a Pennsylvania couple to compel Erie Insurance Co. to arbitration in a suit over coverage stemming from an automobile accident, concluding that the couple waited too long before launching the petition.
