BHP Billiton Says $5M Royalty Fraud Suit Is Too Vague

Law360, Washington (April 22, 2013, 4:40 PM EDT) -- BHP Billiton Petroleum urged an Arkansas federal court Monday to toss a putative class action alleging it, Chesapeake Energy Corp. and BP America Production Co. fraudulently skimmed $5 million off royalty payments to thousands of oil and gas leaseholders over 25 years, calling the suit a “scattershot” of lackluster allegations.

According to BHP, the leaseholders have only made vague allegations accusing the companies and several of their subsidiaries of misconduct over a 25-year period, and failed to attribute any of their claims to specific companies. Unless...
