Fed. Circ. Won't Transfer Qualcomm Network Patent Fight

Law360, Los Angeles (April 23, 2013, 7:55 PM EDT) -- The Federal Circuit said Tuesday that a Texas federal court didn't abuse its discretion when it refused to transfer a lawsuit accusing Qualcomm Inc. and others of infringing a personal area network patent because a licensing agreement clause didn't warrant moving the case.

The ruling means that the dispute will stay in Texas, likely to the benefit of plaintiffs Tri-County Excelsior Foundation and Azure Networks LLC, which are based in that state. The petitioners had argued that a clause in a licensing agreement relating to claims...
