Workers Can Be Fired For Medical Pot Use, Colo. Court Says

Law360, New York (April 25, 2013, 7:17 PM EDT) -- A Colorado appeals court ruled Thursday that a state law barring employers for firing employees for engaging in lawful conduct while off duty does not protect workers who use medical marijuana because the drug remains illegal under federal law.

The appeals court sided with Dish Network LLC's decision to terminate customer service representative Brandon Coats, a quadriplegic who is licensed by the state to use medical marijuana, after he tested positive for marijuana in violation of the company's drug policy.
