Doctor Owed Defense For Transplant Charges: Calif. Court

Law360, Los Angeles (May 1, 2013, 7:49 PM EDT) -- A California appeals court ruled Wednesday that Mt. Hawley Insurance Co. must defend a doctor against charges that he covered up a liver transplant scam, saying that a provision in the state Insurance Code doesn't preclude insurers from defending clients from federal charges.

Richard Lopez, who was the medical director of St. Vincent's Medical Center Comprehensive Liver Disease Center, was indicted in January 2010 for criminal conspiracy, false statements and concealment and falsification of records. After refusing to defend or indemnify him, Mt. Hawley filed suit...
