Fed. Circ. Nixes Motorola Bid To Toss Apple FRAND Appeal

Law360, New York (May 3, 2013, 7:42 PM EDT) -- The Federal Circuit on Friday refused to dismiss an appeal by Apple Inc. in an antitrust and breach of contract dispute with Motorola Mobility Inc. over standard-essential patents, rejecting Motorola's argument that the court lacks jurisdiction because the claims are not patent-related.

The court denied the Google Inc. unit's motion to dismiss the appeal or transfer it to the Seventh Circuit, the circuit that handles appeals from the Western District of Wisconsin, where a judge dismissed Apple's suit last year.
