Expert Wouldn't Have Aided Convicted Dow Engineer: 5th Circ.

Law360, New York (May 7, 2013, 1:45 PM EDT) -- A Louisiana judge should not have excluded a chemical engineer's expert testimony during the trade secrets trial of a former Dow Chemical Co. employee, but the testimony wouldn't have prevented the employee's conviction, the Fifth Circuit said Monday.

Former Dow employee Wen Chyu Liu, also known as David W. Liou, was convicted in 2011 of conspiracy to steal trade secrets for trying to sell the designs of factories to make the industrial chemical chlorinated polyethylene, or CPE, to Chinese companies. He was also convicted of perjury...
