Campbell Says GMO Suit Fails Because USDA Approved Labels

Law360, Miami (May 10, 2013, 9:13 PM EDT) -- Campbell Soup Co. told a Florida federal judge Friday that the court should dismiss a consumer class action alleging the company's 100% Natural line of soups feature false and misleading labeling, because the claims are preempted by prior federal approval.

The case focuses on Fort Lauderdale, Fla., resident Mark Krzykwa's claim that the company is misleading consumers of its 100% Natural Soups line because it uses corn grown from genetically modified seeds in some of the 37 flavors.
