Judge Blows Away $8.9M Award In Wind Farm Suit

Law360, New York (January 15, 2008, 12:00 AM EST) -- A Texas civil district court judge has overturned a jury's award of $8.9 million to the Dallas-based energy company TXU Corp. in a contract squabble with wind farm operator FPL Energy.

TXU, now called Energy Future Holdings Corp., alleged that FPL had breached its contract by failing to provide sufficient levels of wind energy from three West Texas wind farms.

FPL, in turn, claimed TXU purposely clogged high-voltage transmission lines essential for the delivery of wind-turbine-generated electricity.
