Hospital's $350M Bond Issuance Suit Falls In 5th Circ.

Law360, New York (May 14, 2013, 7:40 PM EDT) -- A Louisiana hospital operator on Tuesday lost its suit over bond insurer National Public Finance Guarantee Corp.'s delay in deciding to approve its plan to issue $350 million in additional bonds, when the Fifth Circuit ruled their agreement allowed National Public to withhold approval.

A three-judge panel upheld a lower court's March 2012 ruling that the disputed bond insurance agreement gave the insurer the right of consent for such issuances. The ruling dismisses the suit by Woman's Hospital Foundation, which operates as Woman's Hospital in Baton...
